By using www.bharathtvs.com (hereafter referred to as “the Site”), you attest that you have read and accept the terms and conditions that govern its usage. You are legally bound by these terms and conditions (also known as the “User Agreement”) with Bharath TVS (also known as “bharathtvs.com,” “we,” or “us”). The agreement of this User Agreement upon registration for new users results in its implementation. By publishing the updated terms on the Site, bharathtvs.com is free to change the User Agreement at any time. Together with that, we’ll alert you in line with your notification preferences. You are urged to routinely check for any revisions or updates to the terms and conditions stated in this User Agreement. The validity and enforceability of the remaining provisions of the User Agreement will not be impacted if any provision of the User Agreement is found to be invalid, void, or for any other reason unenforceable.

Before you can join bharathtvs.com, you must read, concur with, and accept all of the terms and conditions contained in this User Agreement and bharathtvs.com’s Privacy Policy, including those that are explicitly outlined below and those that are incorporated by reference.

By accepting this User Agreement, you also concur that the User Agreement and the Privacy Policy displayed on the websites of our subsidiaries and affiliates will apply to your use of those websites.

1. Your Account and Registration Obligations
If you use the Site, you are in charge of keeping the privacy of your account information, such as your email ID and password, and you agree to assume responsibility for all activities that take place under your account or password. You are also in charge of limiting access to your computer. You consent to:

(a) Fill out the forms on the website with genuine, accurate, up-to-date, and comprehensive information about yourself (“Booking Data”); and

(b) To keep the Registration Data truthful, accurate, current, and complete, maintain and immediately update it. Bharathtvs.com reserves the right to permanently suspend or terminate your account and deny you access to the Site if you provide any information that is untrue, inaccurate, not current, or incomplete, or if we have reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, or does not comply with the User Agreement.

2. Use of the Site
You affirm, agree, and undertake that the following laws and regulations will be properly followed when using the site:

(a) Any information you give to us or the other visitors to the website (referred to as “Users”) during registration, in the comments section, or via any email function is referred to as “Your Information.” We serve as a passive conduit for your online distribution and publication of Your Information; we are not responsible in any way for Your Information.

(b) You consent to giving us access to Your Information for the purposes of the Site and acknowledge that we are not infringing upon any of your legal rights with respect to Your Information. As a result, you consent to giving us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, and sub-licensable (through multiple tiers) right to use the copyright, publicity, and database rights (but not any other rights) you may have in Your Information in any media now known or later discovered. Your Information will only be used by bharathtvs.com in compliance with the User Agreement and the Privacy Policy of bharathtvs.com. Additionally, you acknowledge and agree that you will never share any sensitive personal data or information, as defined in Rule 3 of the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, with any other site users, including bharathtvs.com, and that you will always comply with the privacy policy of bharathtvs.com.

3. Privacy
Without your express permission, we never divulge your personal information to third parties for their marketing initiatives; instead, we only use and share your information in accordance with the Privacy Policy. We consider the preservation of users’ privacy to be a crucial community principle. We are aware that one of our most valuable assets is you and Your Information.

4. Breach
Without limiting other remedies, bharathtvs.com may restrict your activity, immediately suspend or terminate your account, and/or refuse to grant you access to the Site if any of the following circumstances arise:

(a) You violate the User Agreement or the documents it incorporates by reference;

(b) We are unable to verify or authenticate any information you provide; or

(d) if you breach the User Agreement or the documents it incorporates by reference, bharathtvs.com reserves the right to recover any damages and amounts due and owing by you to bharathtvs.com and to take strict legal action including but not limited to a referral to the Cyber Crime Division / initiating criminal proceedings against you.

5. No Warranty
Bharathtvs.com clearly disclaims all implied warranties of title, merchantability for a particular purpose, and non-infringement and provides the Site and services “as is” and without any guarantee or condition, express, implied, or statutory. You hereby clearly acknowledge and accept that the use of the Site is at your own risk.

6. Limitation of Liability
No matter how the Site, its services, or this User Agreement are used or affected, neither bharathtvs.com nor its suppliers shall be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses (however arising, including negligence). Thus, bharathtvs.com disclaims all responsibility for any loss of money or other harm you may sustain as a result of:

(i)the transmission of any data or other material that is delayed, unsuccessful, interrupted, or corrupted while using the site; and/or

(ii) the site’s functioning being interrupted or having problems. You explicitly acknowledge and accept that bharathtvs.com shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to damages for loss of revenue, business reputation, goodwill, use, data, or other intangible losses (even if bharathtvs.com has been advised of the possibility of such damages).

7. Indemnity
You acknowledge that by using the Site or by breaching the terms of the User Agreement or the documents it incorporates by reference, or by violating any law or the rights of a third party, you are agreeing to hold us and (as applicable) our parent, subsidiaries, affiliates, officers, directors, agents, and employees harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party.

8 . Relationship and Notice
You and bharathtvs.com are not partners or agents as a result of any of the articles of the User Agreement, and you do not have the right to bind the company in any way.

9 . Arbitration
If there is a disagreement between you and bharathtvs.com regarding the legality, scope, application, or alleged violation of any term of the User Agreement, it will be resolved by a single arbitrator who will be chosen by bharathtvs.com. The arbitrator will be an impartial, independent third party.

10 . Governing Law
The User Agreement shall be governed and construed in accordance with the laws of India.
